legislation dealing with metal detecting and gold prospecting.
MDHTALK's recommendation is to visit their website and give strong

Is Recreational Metal Detecting on the Endangered List?
Metal Detecting took form in the 1950-60s and the detectorists who
were metal detecting at that time had very few restrictions and the
finds were fabulous. Metal detecting during this period can be
described similar to being in the old west with open ranges and
anything goes. The finds stories from those in the hobby during that
period are hard to believe against today’s detecting results.
So is Metal detecting on the Endangered List? Let’s
take a look at the barriers and variables that affect the hobby.
Barriers to Recreational Metal Detecting
The Law: Today, in the U.S. metal detecting environment is
controlled by a hodgepodge of Federal, State, City, County laws. A
major reason for this is that there is no regulation, law or statue
at the Federal level that provides any support for recreational
metal detecting.
Some of the Federal statues were written before metal detecting became a popular hobby and since these acts were drafted to protect America’s
Heritage it may have been felt that users of a metal detector on federal lands would rob America of some of its heritage. There were four major
federal acts drafted to protect America’s heritage and everyone (detectorist) should read each of them. They are:

Legislation and Regulation Issues

The mining community was denied injunctive relief today from Judge Ochoa in San Bernardino Superior Court, stating that in his opinion
that the miners have not shown “Irreparable ” harm. He agrees that we have suffered harm, but not to the extent that injunctive relief
is due. The lawyers for PLP, New 49ers and WMA argued forcefully that the financial losses are irreparable and by allowing the State
of California to continue to violate our Constitutional rights and cite miners for what the Constitution guarantees us IS irreparable!
The Judge wrote in his tentative ruling that because the Reinhart appellate decision has been de-published and is under review from
the California Supreme Court, the Federal preemption issue he ruled upon is also up for review. Trial was set for January 20th, 2016 to
conclude everything before him. PLP, New 49ers and WMA are in process right now of looking at our appeal on what is viewed as
“Justice delayed is Justice denied!” Judge Ochoa did clarify however his ruling on the States exparte motion to ban the new 49ers and
their counsel from filing a temporary restraining order against the State in Siskyou County. He only barred counsel and plaintiffs from
filing a TRO. Look for individuals outside this litigation to act on this very soon.
